Discarding yet another claim of CBI alleging insider job in the double murder of Talwar's daughter Aarushi and Hemraj, the bench of Justices B K Narayana and A K Mishra noted the agency couldn't produce a reliable eyewitness or a scientific report to prove Hemraj's presence in Aarushi's room or explain how his body landed up on the terrace.

The accusations enraged the Talwars and friends, who accused the police of framing the dentist couple in order to cover up a botched investigation. This was the theory propounded by the first CBI team that carried out investigations and was also supported by the narco test on Krishna, one of the servants.
