The NFL players' union has issued notice that it will request an en banc hearing - a hearing of the full panel of judges with the 5th U.S. Circuit Court of Appeals in New Orleans - on behalf of Cowboys running back Ezekiel Elliott. If Elliott's legal team can't put the suspension on hold again, he would miss the 49ers game, plus games against the Washington Redskins, Kansas City Chiefs, Atlanta Falcons, Philadelphia Eagles and Los Angeles Chargers.

By rule, Elliott and the NFLPA have 14 days to file a petition for a rehearing.

Elliott has 393 rushing yards in four games for the Cowboys this season. As of now, Elliott is set to be suspended through Week 12. The 5th Circuit agreed with the NFL's claim that the filing was premature.

"The parties contracted to have an arbitrator make a final decision". Elliott has denied the allegations and was never criminally charged, but under the NFL's domestic violence policy, criminal charges aren't necessary to warrant a punishment. Now, the National Football League has released a statement making it clear that Elliott IS still suspended, contrary to the news that broke last night.
